Diplo has been reported by a woman who accuses him of distributing nude photos of her without her consent. It is what is known as “revenge porn.” The woman is Shelly Auguste, with whom she has been in legal disputes since 2020. As Pitchfork reports, Shelly Auguste has accused Diplo – whose real name is Thomas Wesley Penz – of “sexual assault, gender violence, intentional intrusion into private affairs, assault , defamation, intentional infliction of emotional distress and fraud.
Diplo has always denied the facts, and has requested – like her – a restraining order. His attorney, Bryan J Freedman, said: “For over 3 years, Shelly Auguste has been orchestrating a smear campaign against Wes, and this is more of the same. She now she has done it again. But Wes will fight back and, just as he has done every time Ms. Auguste slandered him, harassed and attacked him and his family, he will win.” Diplo also accused her of harassment, invasion of her privacy and distribution of her private materials.
According to her, they both met through a Twitter private in 2014, when she was 17 years old and he was 35. They met in person in 2018 and had sex in 2019. According to her story, the sex was consensual, but not that he ejaculate inside her or record it. He now accuses her of distributing nude photos of herself, something Diplo’s lawyer has denied.
For his part, Diplo’s lawyer has accused Shelly Auguste of “harassing Diplo and his family for more than a year.” The two reached an agreement in 2021 not to disparage each other. In 2022, a judge determined that Shelly had breached the agreement by publicly referencing Diplo, earning him more than $1 million in damages. Among those violations of the agreement were a retweet by Rihanna (“never underestimate a man’s ability to make you feel guilty for his mistakes”) and a lyric by Taylor Swift (“I don’t regret it one bit, ’cause he had it coming»).
The new complaint comes from the fact that a woman had contacted Shelly Auguste on Instagram indicating that she had received 6 naked photos of her. According to Auguste, Diplo would have distributed them as a way to “get back at her.”
