The Artist Statute advances, but it will not regulate the use of AI

The Council of Ministers will approve this Tuesday, July 21, the Royal Decree on the Statute of the Artist, which will regulate the work of people who carry out their activity in the performing, audiovisual and musical arts, as well as the technical or auxiliary tasks necessary to carry out these practices. Although at one point it was said otherwise, this will not prohibit the use of AI.

The objective of the Artist Statute, since its unanimous approval in 2018, has always been for employees in the cultural sector to enjoy the same rights as other workers and a legal framework adapted to their needs.

Last January it was announced that the Statute would prohibit AI from replacing workers in the sector. However, as confirmed by elDiario.es, this will no longer be the case. Although ministry sources clarify that work is being done to recover the promise, they indicate that the reason it is not included has to do with an “unfavorable report” on the motion.

Some points that are still included in the document are the regularization of the work of minors, the incorporation into the work day of activities related to production, promotion or rehearsals, the mandatory nature of an intimacy coordination figure for sexual scenes and the incorporation of plans and protocols for harassment.
